1. Acceptance of Terms
By accessing and using the Utopia Adventures website "www.utopia-adventures.com", you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these terms, please refrain from using the Website.

a. "User" refers to any individual accessing or using the Website.
4. Use of the Website
a. You must be at least 18 years old or have the consent of a legal guardian to use the Website.
b. You agree to use the Website for lawful purposes and in a manner consistent with all applicable laws and regulations.
5. Intellectual Property
a. All content on the Website, including but not limited to text, graphics, logos, images, and software, is the property of Utopia Adventures and is protected by copyright and other intellectual property laws.
b. You may not reproduce, distribute, modify, display, or create derivative works of any content on the Website without the prior written consent of Utopia Adventures.

a. To access certain features of the Website, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account information and password.
b. Utopia Adventures reserves the right to suspend or terminate your account at its sole discretion if it believes you have violated these Terms and Conditions.
7. Booking and Payments
a. If you make reservations or bookings through the Website, you agree to provide accurate and up-to-date information.
b. Payments for services or products offered on the Website are subject to the terms specified during the booking process.
8. Disclaimer of Liability
a. Utopia Adventures is not responsible for any damages or losses resulting from the use of the Website or the content provided therein.
b. Utopia Adventures does not guarantee the accuracy, completeness, or timeliness of information on the Website.

10. Changes to Terms and Conditions
Utopia Adventures reserves the right to modify or update these Terms and Conditions at any time. It is your responsibility to review these terms periodically for changes.
11. Governing Law and Jurisdiction
a. These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
b. Any disputes arising out of or in connection with these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of England and Wales.

BOOKING CONTRACT
Your booking is confirmed and a contract exists when the Tour Operator or its disclosed agent issues a written confirmation after receipt of the applicable deposit amount. Please check your confirmation carefully and report any incorrect or incomplete information to the Tour Operator or authorised disclosed agent immediately. Please ensure that names are exactly as stated in the relevant passport.
You must be at least 18 years of age to make a booking. You agree to provide full, complete and accurate information to the Tour Operator.
REQUIRED MEDICAL INFORMATION
You must provide any medical information including physical and mental concerns when booking. This allows us to assess any risk our tours may include and provide you with a safe and enjoyable experience.
For certain tours, medical forms are mandatory. If you have any pre-existing medical conditions which may impact your ability to participate on our tours by any means, you must first provide a copy of the medical form, signed by a medical professional prior or at the time of making the booking.
We, and any tour operators, reserve the right to deny you permission to travel or partake in any activities if we know or suspect that a physical or mental condition may render you unfit or unsafe, or if we believe you will render yourself or others unsafe.
Pregnancy is considered a medical condition and this must also be disclosed to the tour operator at the time or prior to booking. We reserve the right to decline anyone access to our tours who may be pregnant.
Our tours include destinations all over the world. Some areas may not have medical facilities that you are familiar with, and medical care may not meet your known standard or be easily accessible. Our tour operators and staff do not provide medical advise and it is your responsibility to assess the risk and requirements of each tour.
You are responsible for assessing whether a tour suits you. Any questions may be directed to info@utopia-adventures.com.
We, or the tour operator, reserve the right to cancel your booking if any of the above are believed to be incomplete or completed incorrectly or falsely.
PRICES, SURCHARGES, TAXES
Tours are priced inclusive of applicable taxes. We reserve the right to amend the price of unsold tours at any time, increase the price of confirmed holidays in order to allow for changes in the tour plan and to correct errors in prices of confirmed tours as a consequence of change in any of the following including but not limited to:
- Change of price in carriages of passengers, fuel, vehicle costs
- Taxes, fees, booking fees, flights or excursions
- Exchange rate fees
- Partner travel operators
You will be charged for the amount of any increases above. However, in the event that we must increase the price, you will be given the option to change your booking to a separate tour.
Should the price of your tour decrease, a refund may be issued dependant on the reason for the decrease. This will not be the case for future promotional sales after you have made a booking and only applies to new bookings.
Bookings where payment of at least a deposit has been received by the Tour Operator or its disclosed agent are not entitled to reduced pricing.
There will be no changes to the cost of the tour within 28 days of the start date of the tour.
DETAILS REQUIRED FOR BOOKING
As a condition of booking, you must provide information requested by the tour operator along with the final payment. If you fail to supply any requested information you will be liable for any additional costs. Any deposits will not be refunded unless it is fault of the operator. If information is not provided, we reserve the right to consider your booking cancelled and a refund of any prior payments may not be issued.
CHANGES AND CANCELLATIONS OF A TOUR
Under certain circumstances a tour may need to be cancelled or adjusted prior or at the time of the tour. On most occasions this will be discussed in good faith and we will refund any necessary payments, however for certain circumstances changes may occur without warning, this may include but is not limited to: Unforeseeable extreme weather, unforeseen conditions, flight delays or extreme natural disasters.
- Changes in accommodation including lower standard or classification for a significant or entire time on the tour may occur.
- Change of departure date may occur.
- Significant change to the itinerary, missing out on one or more advertised excursions or destinations
- Absolute cancellation of the tour.
Compensation of a reasonable amount will be refunded where the above may occur.
TRAVEL DOCUMENTS
It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates including but not limited to vaccination or medical certificates) and insurance policies. You must have a passport that is valid 6 months after the last date of travel with the tour Operator as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the tour, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. When booking, you agree that you are responsible for the full amount of any loss or expense incurred by the tour operator that is a direct result of your failure to secure or be in possession of proper travel documentation. The tour operator does not provide advice on travel documents and makes no representations or warrantees as to the accuracy or completeness of any information provided on visas, vaccinations, climate, clothing, baggage, or special equipment and you agree that the Tour Operator is not responsible for any errors or omissions in this information. You will bring a mobile device with access to the internet for certain documents that may be required to be completed at airports prior to or on arrival at your destinations. You are responsible from providing travel insurance that fits the needs of the destination and itinerary for the trip.
ACCEPTANCE OF RISK
You acknowledge that adventure travel and services offered by Utopia Adventures may involve significant risk to your health and safety. Whilst we make every effort to avoid risks, you must decide for yourself if each trip, destination and activity is safe. You assume responsibility for all such risks and release the tour operator from all claims and causes of actions arising from any losses, damages, injury or death resulting from risks inherent from travel. This includes but is not limited to adventure travel, visiting foreign destinations, participating in activities named in the itinerary travelling to and from them by vehicle (land or water) or foot. Hygiene, accommodation and in certain countries where the standards of safety are lower than your home country. You acknowledge this risk upon booking a tour.
You must comply with local laws and restrictions at all times. Should you fail to comply or commit illegal actions when on tour, or present any acts or omissions that present a risk to the health, safety or legal requirements of at the destination, the tour operator reserves the right to terminate your travel arrangements on all arranged products and services without refund.
You are responsibly for all costs of damage, repair, replacement, destruction, theft and cleaning fees incurred whilst on tour.
You agree to take all appropriate measures to ensure the safety of yourself and others whilst on a tour. If at any point you are aware of risks to safety, you must inform the travel operator immediately.
IMAGES AND MARKETING
Upon booking a tour, you agree that the tour operator and other persons within the tour will collect images and videos for marketing purposes. This may be produced on websites, social media platforms and shared publicly. If you have any issue with being photographed, it is your responsibility to let the tour operator know at the earliest opportunity and reasonable steps will be taken to accommodate that.
